Traditional Judaism believes there is a dual Torah, consisting of Sh'b'ktav Torah (the written Torah) and Torah Sh'Ba'al Peh (oral Torah). Commandments or rules derived from the written Torah are called "d'Oraita" of the Aramaic word meaning "of the Torah."

For classical Judaism, the Oral Torah is the oral Torah revealed simultaneously in the Sinai, as well as decrees or laws instituted by the rabbis later (d'Rabbane). The base or the authority of the laws classified as "d'Rabbane" and the application of enforcement the commandments is derived from Deuteronomy 17:8-11.

The rabbis claim that the authority to interpret the commandments and then define (ie how keeping the commandments) is written in the Torah itself, where Moses says that any issues or very difficult issue for the Jewish people in the days come must be brought before the priests and judges in office at that time.

The rabbis serve as judges and legislators similar to a court and a legislature. The dayanim rabbis fact (judges). The constitution serves as the written Torah of Israel and the Oral Torah and the rabbis who acts as the legislative process. Like the Constitution United States, the actual application of the statutes and the future requirements of the statutes are left in Congress and the validity of those laws is left to the courts. The concept of a constitutional model of Torah law that "evolve" or is "flexible" allows you to remain relevant and applicable.

A model the Torah that does not include this time creates a situation in which many biblical commandments can not be observed, applied, or understand. Therefore a community like the Karaites, who argue that only the biblical text still have almost reached the point of extinction, have been isolated and, in fact, excluded themselves from the Jewish community by adopting different calendar and different laws. In the end, however, that created a body of its own "halacha" of necessity, trying to follow the written text.

The issue or argument in favor of the oral Torah that exists on two levels. In a very basic level, the very necessity of the oral Torah can be established by looking at the text of the Torah same.

The scrolls of the Torah is written with consonants only, without vocals. So a word written in Hebrew can have multiple meanings. By Therefore, where the Hebrew text says "BNCH," could do this as Bonayich "," your Builders "or" B'nayich " "your sons". This happens very often. Vowel marks were added later only after the text was written and codified.

Thus, even our own ability to read and understand the text is based on an oral tradition that gives us the ability of both to pronounce the alphabet, reading, and most importantly understand the text.

The famous Hillel was approached by a non-Jew who wanted to learn Torah with the condition that only the written Torah learned. He began to teach the alef-bet and the next day changed the names of the letters and their pronunciation and the student was confused. He did it to prove a point!

The text is essential, but is informed and understood only with the help of oral tradition.
